Selling to the UK remains an attractive market for many Amazon sellers. Since Brexit, however, different rules apply there compared to the EU in some cases. Especially with private label products, uncertainties quickly arise: Is a UK importer required? Is a UK Rep sufficient? Does the product need to be marked with CE or UKCA? And what documents should you have ready in the event of an Amazon review?

This blog post tells you what you really need to pay attention to when selling in the UK and where the most common pitfalls lie in practice.

CE / UKCA or General Product Safety: What applies to your product?

First, you must classify your product correctly. There are two broad categories here:

Products with CE or UKCA relevance

These include, for example, toys, electrical appliances, personal protective equipment, or radio products. Here, specific regulations and mostly stricter testing obligations apply. "Simple" products without CE or UKCA obligation

Products such as textiles, furniture, simple decorative items, or kitchen utensils without an electrical function do not require a CE or UKCA mark. Nevertheless, they are not “compliance-free”. Here, too, the general requirements for product safety as well as special regulations, such as labeling obligations or fire safety specifications, must be met.

UK Importer and UK Representative: What is the difference?

There is often confusion among sellers about the distribution of roles in the UK. In practice, two terms must be cleanly separated from each other:

The UK Importer

An importer is an economic operator established in the UK who introduces a product from outside, for example from the EU or China, into the British market. The role of the importer arises from the actual supply chain.

The UK Authorized Representative (UK Rep)

A UK Rep, on the other hand, is a body in the UK commissioned in writing by the manufacturer. It takes on defined tasks on behalf of the manufacturer, such as keeping technical documentation available for authorities.

Important for you as an e-commerce seller:

  • A UK Rep is not automatically a one-to-one replacement for an importer.
  • Whether you absolutely need an importer or a Rep in your setup depends on the respective product regulation and your distribution channel.

Correct labeling for Amazon UK

Amazon checks in the UK similarly to the EU whether the offered products meet the legal requirements. To avoid problems with activation or later suspensions, the labeling on the product and packaging should be consistent from the start.

The following information should be available at a minimum:

  • Manufacturer Information: Your brand name and a deliverable postal address.
  • Economic Operator in the UK: Depending on the setup and product specification, the details of an economic operator established in the UK, such as an importer or UK Rep, must be attached to the product and the packaging.
  • Product Identification: Your product must be clearly identifiable, for example by an article number, type designation, or EAN. A batch number is not generally mandatory for all products, but may be required depending on the category.
  • Language: Warnings, safety instructions, and manuals must be written in easily understandable English.
  • Markings: CE or UKCA marks may only be affixed if the product actually falls under the corresponding regulations and objective evidence of conformity is available, such as test reports from accredited laboratories.

When Amazon requests documents, you must be able to prove that your product is compliant. Depending on which regulations apply to your product, Amazon wants to see different documents and evidence:

Category 1: Sales based on CE marking

In the areas where the UK continues to recognize the CE marking, for example toys or electrical items, the CE Declaration of Conformity is usually sufficient. It is important, however, that the UK Representative or importer is included on this declaration if relevant to your setup. An additional British Declaration of Conformity is normally not necessary in this case.

Category 2: Sales based on UKCA marking

If you have had your product tested according to British standards and bring it to the market with the UKCA mark, you absolutely need a UK Declaration of Conformity. This must explicitly name the relevant British legislation, for example “Electrical Equipment (Safety) Regulations 2016“.

Category 3: "Simple" products without CE/UKCA, e.g., furniture, textiles, decor

Even if no Declaration of Conformity exists for these products, Amazon normally requests pictures of all attached markings here. With this, Amazon checks whether general product safety is guaranteed.

This is particularly critical if your product is subject to special British rules, such as the UK Fire Safety Regulations for furniture. Here you must be able to prove that the mandatory and often very specific permanent and display labels are correctly attached to the product. Without this picture evidence, it can happen that the product listing is suspended sooner or later.

What you should generally have ready

Regardless of the category, you should have the following documents in your archive:

  • Declarations of Conformity, if applicable
  • Technical documentation and test reports, for example flammability tests for furniture or REACH test reports
  • Current, high-resolution photos of the markings on the product and packaging, as evidence for Amazon
  • Safety assessments or risk assessments

Special case Northern Ireland

Please note: The above rules apply primarily to Great Britain (England, Scotland, Wales). Due to its special status, many EU rules continue to apply to Northern Ireland. If you offer your products throughout the UK, you should therefore always check whether there are additional or fewer requirements for Northern Ireland.

Conclusion for private label sellers

Anyone selling under their own brand in the UK bears full responsibility for product compliance. A simple “my manufacturer takes care of that” is often not enough, as you legally usually step into the role of the manufacturer yourself.

To operate safely in the UK market, you should:

  1. Check whether your product is CE or UKCA relevant.
  2. Clarify your setup of importer or UK Rep.
  3. Adapt the labeling on the product and packaging.
  4. Keep all necessary documents ready for queries by Amazon or authorities.
