REACH. The fact that manufacturers from Asia in particular tend to use these terms synonymously, and can present an RoHS test report for virtually any product, exacerbates this problem.<\/p><p>But that does not mean that this is correct. Both the <a href=\"https:\/\/echa.europa.eu\/regulations\/reach\/understanding-reach\" target=\"_blank\" rel=\"noopener\"><strong>REACH Regulation<\/strong><\/a> and the RoHS Directive <strong>restrict the use of certain substances<\/strong>. Even though there are overlaps, the two regulations differ in regard to the product scope, the labeling requirements and the substance restrictions.<\/p><p>This blog post details all the differences between the REACH Regulation and the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:32011L0065\" target=\"_blank\" rel=\"noopener\"><strong>RoHS Directive<\/strong><\/a>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e24d7fe elementor-widget elementor-widget-heading\" data-id=\"e24d7fe\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Scope of the two European regulations<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-350a50a elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"350a50a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c67ad64 elementor-widget elementor-widget-text-editor\" data-id=\"c67ad64\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Both regulations restrict the use of certain substances in products. However, the <strong>scope of application of the RoHS Directive is significantly smaller<\/strong>, as it <strong>only refers to electrical and electronic devices<\/strong>.<\/p>\n<p>If your manufacturer presents an RoHS test report for a non-electrical product, you know right away that you cannot use that. Having only a small number of materials RoHS-tested is relatively cheap for the manufacturer, and unfortunately, most sellers believe that such a test report is enough to allow them to assume that a product is chemically safe.<\/p>\n<p>In the case of an investigation by the authorities, the report will not hold up for the simple reason that the respective product is not subject to the RoHS Directive. Please note: If you affix your own trademark to the product, you are deemed to be a <a href=\"https:\/\/compliance.tradavo.eu\/en\/economic-operators\/\"><strong>(quasi) manufacturer<\/strong><\/a> in the EU. <strong>This means that you bear the full responsibility for your product!<\/strong> Manufacturers from third countries, e.g., China, have nothing to fear, which is why they deliberately and unscrupulously use such means to deceive you.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8ee3d95 elementor-widget elementor-widget-heading\" data-id=\"8ee3d95\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">The REACH Regulation<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-41c8f82 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"41c8f82\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-91370db elementor-widget elementor-widget-text-editor\" data-id=\"91370db\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>If the term REACH Regulation means nothing to you, we recommend reading <strong><a href=\"https:\/\/compliance.tradavo.eu\/en\/reach-regulation-part-1\/\">part 1<\/a><\/strong> and <a href=\"https:\/\/compliance.tradavo.eu\/en\/reach-regulation-part-2\/\"><strong>part 2<\/strong><\/a> of our series on the REACH Regulation. In a nutshell, REACH regulates the <strong>use of harmful and hazardous substances in composites and products<\/strong>. The Regulation requires importers and manufacturers to ensure that their products do not present hazards to the environment and human health.<\/p>\n<p>The REACH Regulation covers any and all chemicals, including those used in products. Consequently, there is virtually no product that is not subject to the REACH Regulation. Generally speaking, the RoHS Directive restricts the use of various hazardous substances in electrical equipment.<\/p><p>The equipment covered by the RoHS Directive is defined in Annex I, e.g.:<\/p><ul><li>large and small household appliances<\/li><li>IT and telecommunication devices<\/li><li>consumer equipment<\/li><li>tools<\/li><li>toys<\/li><li>recreational and sports equipment<\/li><li>control instruments<\/li><li>lighting equipment<\/li><li>medical equipment<\/li><\/ul><p>\u00a0<\/p><p>However, electrical equipment that is not specifically listed in Annex I is subject to the RoHS Directive as well! Exceptions from the RoHS Directive are specified in Annex II. This explains why RoHS testing is so much more convenient for manufacturers, in particular if a single material is to be tested for the above-mentioned 10 substances.<\/p><p>The REACH Regulation contains a <a href=\"https:\/\/echa.europa.eu\/candidate-list-table\" target=\"_blank\" rel=\"noopener\"><strong>candidate list for substances of very high concern<\/strong><\/a> (SVHC) that may have serious effects on human health and\/or the environment. However, you are not allowed to use a \u201cREACH lab test\u201d for sales promotion because that would be considered \u201cadvertising with obvious facts\u201d.<\/p><p>The situation is different for <strong>compounds<\/strong>: Depending on the categorization of a compound, the so-called <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:32008R1272\" target=\"_blank\" rel=\"noopener\"><strong>CLP Regulation<\/strong><\/a> may apply and result in additional labeling requirements. Again, you are not allowed to advertise the product as CLP-compliant.
