In the best case, the customers immediately rate your product better than the competitors\u2019 offers.<\/p>\n<p>That is something you can achieve with better product quality, or with more appealing <strong>advertising<\/strong>. Due to the growing number of new competitors surging into the market nowadays, some sellers fall back on questionable marketing methods in order to give themselves an <strong>unfair competitive edge<\/strong>. Today, we are going to take a closer look at <strong>compliance pitfalls in marketing<\/strong>. <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8ee3d95 elementor-widget elementor-widget-heading\" data-id=\"8ee3d95\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Misleading advertisement of self-evident properties (Section 5 UWG) <\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-91370db elementor-widget elementor-widget-text-editor\" data-id=\"91370db\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The <strong><a href=\"https:\/\/www.gesetze-im-internet.de\/englisch_uwg\/index.html\" target=\"_blank\" rel=\"noopener\">German Act against Unfair Competition<\/a> (UWG)<\/strong> is first and foremost meant to protect consumers against misleading information in advertisements. Pursuant to Section 5 UWG, a commercial activity is deemed to be misleading if it contains false information. If the information is accurate, but potentially deceptive for the consumer with respect to certain circumstances, it is deemed to be misleading as well.<\/p><p>Such <strong>misdirection<\/strong> is for example given if a <strong>property of a product that is, in fact, self-evident<\/strong> is advertised in a manner that makes the customer believe that it is a special feature of the product. This way, the product appears to be better than those of the competition, even though it does not actually have any different, \u201cspecial\u201d features.<\/p><p>Section 5 UWG covers:<\/p><ul><li>Advertising with the CE marking (\u201cCE certified\u201d) or the RoHS symbol (\u201cRoHS-compliant\u201d)<\/li><li>Advertising with test results under the German Food and Feed Code [LFGB] or the REACH Regulation<\/li><li>Advertising with so-called <a href=\"https:\/\/compliance.tradavo.eu\/en\/ce-marking-part-1\/\"><strong>harmonized standards<\/strong><\/a>, e.g., \u201ccomplies with the requirements of DIN EN 71-1\u201d<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1ef2810 elementor-widget elementor-widget-heading\" data-id=\"1ef2810\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Trademark infringements<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f5479ec elementor-widget elementor-widget-text-editor\" data-id=\"f5479ec\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Many sellers wrongly believe that they can freely use other companies\u2019 logos or symbols, such as the T\u00dcV tag or the Green Dot, for their own promotional activities. This can be a costly mistake! If the logo or symbol is a registered trademark, and you failed to obtain a license for its use, this is a <strong>trademark infringement<\/strong>. Let us take a closer look at the most common mistakes on Amazon.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0657bb8 elementor-widget elementor-widget-heading\" data-id=\"0657bb8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Advertising with the Green Dot<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e41e892 elementor-widget elementor-widget-text-editor\" data-id=\"e41e892\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tIf you participate in the <strong><a href=\"https:\/\/www.gruener-punkt.de\/en\/\" target=\"_blank\" rel=\"noopener\">Green Dot<\/a><\/strong> dual system in Germany, you are allowed to put their logo on your product packaging\u2014provided that you send your products <strong>only to customers from Germany<\/strong>. Attention: You need a separate license for each EU country!\n\nIf you participate in the dual system, you are allowed to show the Green Dot in product images depicting the packaging. If, however, your packaging is not licensed under the Green Dot system, and your company does not have its own marketing license, you are not allowed to attach the symbol, nor to use it for promotional purposes on Amazon.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dceca6b elementor-widget elementor-widget-heading\" data-id=\"dceca6b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Advertising with textile labels such as GOTS, OCS or Oeko-Tex<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-47d960e elementor-widget elementor-widget-text-editor\" data-id=\"47d960e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>If your textile products are not duly GOTS, OCS or Oeko-Tex certified, you are not allowed to use the corresponding logos and seals for your sales promotion. Furthermore, the above-mentioned <strong><a href=\"https:\/\/compliance.tradavo.eu\/en\/eu-textile-labeling-regulation\/\">certifications<\/a><\/strong> require not only your specific product, but also the manufacturer from whom you procure said product to be certified.<\/p>\n<p>If you advertise one of these textile seals, you must indicate the respective <strong>certification number<\/strong> (e.g., that of your manufacturer). Compliance with such standards is not always mandatory in the EU. However, if you want to advertise the above-mentioned properties, you have to make sure that you can prove them. In most cases, that is not a permanent solution because the duration of such a ban depends on the severity of the infringement.<\/li>\n<li><strong>Contact the trademark owner:<\/strong> You can, of course, also contact the trademark owners themselves, e.g., T\u00dcV, FSC or others, and tell them that a competitor is illegally advertising on Amazon using their seals.
