sellers tend to neglect. This is because infractions usually do not entail any consequences, especially in product categories that are not or scarcely monitored by the authorities.<\/p><p>However, the introduction of the new <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:32023R0988\" target=\"_blank\" rel=\"noopener\"><strong>EU Product Safety Regulation<\/strong><\/a> could fundamentally change that. The Product Safety Act implemented the <strong><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:32001L0095\" target=\"_blank\" rel=\"noopener\">General Product Safety Directive 2001\/95\/EC<\/a><\/strong> of the EU.<\/p>\n<p>As of April 25, 2023, the European Council adopted the new <strong>EU Product Safety Regulation<\/strong> (GPSR). This means that the old Directive 2001\/95\/EC is being replaced by the new Regulation. If you do not yet know the difference between a Directive and a Regulation, you can learn more about it in <strong><a href=\"https:\/\/compliance.tradavo.eu\/en\/waste-electrical-and-electronic-equipment\/\">this blog<\/a><\/strong> post.<\/p>\n<p>Due to this fact, the German Product Safety Act is replaced to a large extent as well. The Product Safety Act will then apply almost exclusively for the B2B segment. The GPSR is introduced in order to ensure that <strong>only safe non-harmonized consumer products are marketed<\/strong>. Furthermore, the GPSR is intended to cover digitized products and the challenges posed by new business models as well.<\/p>\n<p><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8ee3d95 elementor-widget elementor-widget-heading\" data-id=\"8ee3d95\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">When does the new Product Safety Regulation come into effect?<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-91370db elementor-widget elementor-widget-text-editor\" data-id=\"91370db\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The new Product Safety Regulation came into force as of June 12, 2023. It will apply as of <strong>December 13, 2024<\/strong>. Enough time to prepare for the changes it brings, at least in theory. During the <strong>18-month transitional period<\/strong>, non-harmonized consumer products may still be sold on the market pursuant to the Directive 2001\/95\/EC and the Product Safety Act. This includes manufacturers, authorized representatives, importers and sellers. Furthermore, the Regulation expands the <strong>pers<\/strong><strong>onal scope of application<\/strong>.
